1. Agreement to Terms
These Terms of Service (“Terms”) govern your access to and use of the OneTeam platform, website, applications, and services (collectively, the “Services”) provided by OneTeam AI, Inc. (“OneTeam,” “we,” “us,” or “our”).
By creating an account, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
2. Who May Use the Services
You may use the Services only if:
- You are at least 18 years old, or the legal age of employment in your jurisdiction
- You have the authority to enter into these Terms
- You are using the Services in compliance with applicable laws
If you use the Services on behalf of a business, you represent that you have authority to bind that business to these Terms.
3. The OneTeam Service
OneTeam provides an AI-powered hiring platform that helps businesses:
- Source and match candidates
- Screen applicants
- Schedule interviews
- Communicate with candidates
- Manage hiring workflows
AI-assisted decisions
OneTeam uses artificial intelligence to assist with hiring processes. AI systems are designed to support decision-making, not replace human judgment.
Businesses are solely responsible for:
- Hiring decisions
- Employment terms
- Compliance with employment laws
OneTeam is a technology platform only. We are not an employer, staffing agency, or employment agency, and we do not guarantee employment, candidate availability, or hiring outcomes. No employment, partnership, or agency relationship is created between OneTeam and any user.
4. Accounts
To use certain features, you must create an account.
You agree to:
- Provide accurate information
- Keep your login credentials secure
- Notify us of unauthorized use
You are responsible for all activity under your account.
We may suspend or terminate accounts that violate these Terms.
5. User Responsibilities
5.1 Businesses
If you are a business using OneTeam, you agree:
- All job postings are accurate and lawful
- You will not discriminate unlawfully
- You will comply with all employment and labor laws
- You will use candidate data only for legitimate hiring purposes
5.2 Candidates
If you are a job candidate, you agree:
- Information you provide is accurate
- You will not impersonate others
- You will not submit unlawful or offensive content
6. Acceptable Use
You agree not to:
- Use the Services for illegal or fraudulent purposes
- Harass, threaten, or discriminate against others
- Attempt to access other users’ data
- Reverse engineer or interfere with the platform
- Upload viruses or malicious code
- Use the platform to build a competing service
We may suspend or terminate accounts that violate these rules.
7. Data and Privacy
Your use of the Services is also governed by our Privacy Policy.
By using the Services, you agree to the collection and use of information as described in the Privacy Policy.
Candidate data
Businesses receive candidate information for hiring purposes only. Businesses are responsible for how they use candidate data after accessing it.
8. Fees and Payments
Some features of the Services may require payment.
If you subscribe to a paid plan:
- You agree to pay all applicable fees
- Fees are billed in advance unless stated otherwise
- Payments are non-refundable except as required by law or expressly stated otherwise in writing
We may change pricing or introduce new fees with reasonable notice.
9. Intellectual Property
9.1 OneTeam’s rights
The Services, including:
- Software
- AI systems
- Designs
- Content
- Trademarks
are owned by OneTeam or its licensors and are protected by intellectual property laws.
You may not copy, modify, distribute, or create derivative works without permission.
9.2 User content
You retain ownership of your data, such as:
- Job descriptions
- Candidate profiles
- Messages
- Documents
OneTeam processes your data solely to provide and improve the Services, as described in our Privacy Policy.
You grant OneTeam a worldwide, non-exclusive, royalty-free license to:
- Use
- Store
- Process
- Display
that content as necessary to provide the Services.
10. Service Availability
We aim to provide reliable Services but do not guarantee:
- Continuous availability
- Error-free operation
- Specific results
We may modify, suspend, or discontinue any part of the Services at any time, including features, functionality, or availability, with or without notice.
11. Third-Party Services
The Services may integrate with third-party tools, such as:
- Email providers
- Calendar services
- Payment processors
We are not responsible for the practices or performance of third-party services.
12. Beta or Experimental Features
We may offer features identified as “beta,” “preview,” or “experimental.” These features may be incomplete, may change, and may be discontinued at any time. They are provided “as is” without warranties or service guarantees.
13. Disclaimers
The Services are provided “as is” and “as available.”
To the maximum extent permitted by law, OneTeam disclaims all warranties, including:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
We do not guarantee:
- Job placement
- Hiring outcomes
- Candidate quality
- Compliance with employment laws
14. Limitation of Liability
To the maximum extent permitted by law:
OneTeam will not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, revenue, or data
- Hiring decisions or employment disputes
Our total liability will not exceed:
- The amount you paid to OneTeam in the 12 months before the claim, or
- $100 if you have not paid us anything
15. Indemnification
You agree to defend, indemnify, and hold harmless OneTeam from any claims arising out of:
- Your use of the Services
- Your violation of these Terms
- Your job postings or hiring decisions
- Your violation of applicable laws
16. Termination
You may stop using the Services at any time.
We may suspend or terminate your account if:
- You violate these Terms
- You misuse the Services
- We are required to do so by law
Upon termination:
- Your right to use the Services ends
- Certain provisions of these Terms will survive
17. Force Majeure
OneTeam will not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including acts of God, natural disasters, internet or hosting failures, labor disputes, government actions, or other events beyond our control.
18. Changes to the Terms
We may update these Terms from time to time.
If we make material changes, we will:
- Update the “Last updated” date
- Provide notice where required
Continued use of the Services means you accept the updated Terms.
19. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.
Any disputes will be resolved in the courts located in Delaware, unless otherwise required by law.
20. Export Compliance
You may not use the Services in violation of U.S. export control laws or other applicable laws.
You represent that you are not located in, under the control of, or a national or resident of any restricted country or prohibited party.
